Terms of Service

Last updated: 7 June 2025

Please read these Terms of Service carefully before using the DeCarbonOPS platform (“Service”) operated by DeCarbonOPS (“we”, “us”, “our”). By accessing or using our Service, you agree to be bound by these terms.

1. Description of service

DeCarbonOPS provides a software tool that helps businesses calculate and report their greenhouse gas (GHG) emissions using the GHG Protocol Corporate Standard and DEFRA 2023 emission factors. The Service generates a “Carbon Passport” — a structured summary of your self-reported emissions data that you can share with procurement partners, auditors, or publish publicly.

2. Important disclaimer — not professional advice

Read carefully

The calculations and reports generated by DeCarbonOPS are based entirely on the data you input. We do not independently verify, audit, or certify any emissions data. Carbon Passports generated by our platform are self-reported and should not be treated as independently audited or certified under ISO 14064 or any other standard unless you separately engage a third-party verifier.

DeCarbonOPS is not a substitute for professional environmental consulting, legal advice, or third-party GHG auditing. If your organisation has formal CSRD, CDP, or other regulatory reporting obligations, you are responsible for ensuring compliance with those specific requirements.

3. Accounts and eligibility

  • You must be 18 years or older to create an account
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You may not use the Service for any unlawful purpose
  • One account per individual or organisation on the Free plan

4. Free plan limitations

The Free plan permits one (1) annual emissions report per calendar year per account. Additional reports require a paid subscription. We reserve the right to enforce this limit by restricting creation of additional reports on Free accounts.

5. Acceptable use

You agree not to:

  • Enter false, misleading, or fabricated emissions data
  • Use Carbon Passports generated from false data in regulatory submissions
  • Misrepresent DeCarbonOPS-generated reports as independently audited or certified
  • Attempt to reverse-engineer, scrape, or circumvent the platform
  • Resell or sublicense access to the Service without written permission
  • Use the platform to process data belonging to third parties without their consent

6. Accuracy of data and calculations

Our emission factor calculations follow the GHG Protocol Corporate Standard using DEFRA 2023 emission factors. We make no warranty that these calculations satisfy the specific reporting requirements of any particular standard, regulation, or jurisdiction. Emission factors change annually; results from previous years should be reviewed against current factors before formal submission.

You are solely responsible for the accuracy of data you enter into the platform.DeCarbonOPS accepts no liability for errors in your Carbon Passport that arise from inaccurate, incomplete, or misleading data inputs.

7. Public Carbon Passports

When you publish a Carbon Passport, you grant DeCarbonOPS a non-exclusive, worldwide, royalty-free licence to display that data at the public URL for as long as your account is active. You represent that you have the authority to publish this data on behalf of your organisation and that doing so does not violate any applicable law or regulation.

8. Intellectual property

The DeCarbonOPS platform, including its design, software, and methodology, is owned by DeCarbonOPS. You retain ownership of all emissions data you input. By using the Service, you grant us a limited licence to process your data solely to provide the Service as described.

9. Limitation of liability

To the maximum extent permitted by applicable law, DeCarbonOPS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

  • Regulatory fines or penalties resulting from reliance on our calculations
  • Loss of contracts or business opportunities
  • Damage to reputation arising from published Carbon Passports

Our total aggregate liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.

10. Termination

You may delete your account at any time via account settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be retained for 90 days then permanently deleted, except where retention is required by law.

11. Changes to these terms

We may update these Terms from time to time. We will notify you by email at least 14 days before any material changes take effect. Continued use of the platform after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the European Union and, where applicable, the laws of the country in which DeCarbonOPS is incorporated. Any disputes shall be resolved in the competent courts of that jurisdiction.
